Terms of Service

Welcome to MindAura ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the MindAura website, mobile web app, and any related services (collectively, the "Service").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What MindAura is

MindAura is a booking marketplace and business-management platform that connects customers ("you", "Customer") with independent beauty, wellness, and fitness businesses ("Businesses") that use MindAura to accept appointments, sell services, and manage their operations.

MindAura is not the provider of the services listed on the platform. Each Business is an independent operator. MindAura does not employ the therapists, aestheticians, or other service providers listed on the platform.

2. Account eligibility

You must be at least 18 years old to create an account. By creating an account you represent that:

• The information you provide is accurate and up to date
• You have the legal capacity to enter into these Terms
• You will not use the Service for any illegal or unauthorized purpose

3. Bookings and payments

• When you book an appointment through MindAura, you enter into a direct agreement with the Business you booked with. MindAura facilitates the booking but is not a party to the service agreement.
• Prices, availability, cancellation policies, and service descriptions are set by each Business. You should review them before booking.
• Payment is processed via Stripe or paid directly at the business at the Business's discretion. When you provide payment information, you authorize MindAura and its payment processors to charge your payment method for the amount owed.
• If a deposit is required to hold your appointment, the deposit is non-refundable unless the Business's stated policy or applicable law says otherwise.

4. Cancellation and no-show policy

Each Business sets its own cancellation policy. Cancellations made within the Business's stated window may be charged in full. Failure to show up ("no-show") may result in a charge and may affect your ability to book with that Business in the future.

5. SMS and email communications

By providing your phone number or email address, you consent to receive:

• Transactional messages (booking confirmations, reminders, receipts, cancellations)
• Marketing messages from the Businesses you have booked with, unless you opt out

You may opt out of marketing messages at any time by replying STOP to any SMS or clicking the unsubscribe link in any email. Standard message and data rates may apply.

6. Acceptable use

You agree not to:

• Impersonate any person or entity, or misrepresent your affiliation
• Post false, misleading, or defamatory reviews
• Circumvent MindAura's booking flow to avoid paying fees or platform charges
• Reverse-engineer, scrape, or automate access to the Service without our written permission
• Introduce viruses, worms, or other malicious code to the Service
• Use the Service to harass, threaten, or abuse anyone

7. User-generated content (reviews, photos, messages)

You retain ownership of content you post, but grant MindAura a worldwide, royalty-free, non-exclusive license to display, distribute, and modify that content in connection with operating the Service.

You are responsible for the content you post. We may remove content that violates these Terms.

8. Business accounts (owners and staff)

If you are a business owner or staff member using MindAura to accept bookings, additional terms apply:

• You are responsible for the accuracy of your business listing, staff profiles, service prices, and hours
• You represent that you have all necessary licenses, permits, and insurance to operate your business and provide the listed services
• You are responsible for taxes on income received through the platform
• You agree to honor the cancellation and refund policies you have published
• MindAura may charge subscription fees or per-transaction fees as disclosed on the pricing page. Fees are subject to change with 30 days notice.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MindAura does not warrant that the Service will be uninterrupted or error-free, or that any Business's services will meet your expectations.

MindAura is not responsible for the quality, safety, legality, or any other aspect of the services provided by Businesses through the platform.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDAURA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR PERSONAL INJURY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

MindAura's total liability for any claim relating to these Terms or the Service will not exceed the amount you have paid MindAura in the 12 months before the claim arose, or USD $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless MindAura, its officers, directors, employees, and agents, from any claims arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

You may stop using the Service at any time. MindAura may suspend or terminate your account if you violate these Terms or if we reasonably believe your account is being used for fraudulent or abusive purposes.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service. Continued use of the Service after the effective date of the updated Terms constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms will be resolved in the state or federal courts located in San Mateo County, California, unless we agree otherwise.
